Twenty-seven states now ban or restrict gender-affirming medical care for transgender minors. The Supreme Court made it worse in June 2025, ruling 6-3 in United States v. Skrmetti that Tennessee's ban does not violate the Equal Protection Clause. That removed the main constitutional argument against state bans.

Now the federal government is going further. CMS proposed two rules in December 2025 that would bar any Medicare- or Medicaid-certified hospital from providing gender-affirming care to anyone under 18. A second rule would prohibit state Medicaid and CHIP plans from covering the same treatments. If finalized, it takes effect October 1, 2026.

Tell your senators to oppose CMS rules 2025-1823 and 2025-23464. Courts are still pushing back — Kansas blocked its ban in May 2026 with a 117-page ruling. This fight is not over. Federal rules threatening hospital Medicare certification as leverage will harm far more than trans youth.
